Genesco Sues Visa Over PCI Compliance

Genesco, the Tennessee-based apparel and footwear provider, has filed a lawsuit against Visa, challenging fines it was issued by the electronic payments network over PCI compliance, Bank Credit News reports.

Genesco is suing to recover $13.3 million in non-compliance fines, and is aiming to challenge Visa’s claims of its non-compliance. Genesco said it was compliant with PCI guidelines when the fines were issued, and that any stolen data was the result of a 2010 security breach.

“This is the first time that a merchant has actively argued against PCI compliance,” Terrance Howard, a PCI compliant web-hosting provider, told the media outlet. “Genesco just may be setting a new legal precedent for fighting future noncompliance fines.”

Visa has moved to dismiss the complaint.
