Class wins certification for suit alleging Big Four railroads fixed fuel surcharges

U.S. District Judge Paul Friedman (District of Columbia) certified a class alleging that U.S. freight railroads fixed fuel surcharges between 2003 and 2008. The surcharges were unrelated to actual costs, according to the complaint, and generated billions of dollars of profit for the railroads.

    The class is comprised of eight shipping companies, including Olin Corp., Dakota Granite, and U.S. Magnesium. The railroads are Union Pacific, Norfolk Southern, CSX Transportation and Burlington Northern Santa Fe Railway: these railroads control 90 percent of the U.S. rail freight market.
