Antitrust Cases Frozen in Mexico as Competition Authority Shuts Down

All ongoing antitrust investigations handled by Mexico’s Federal Economic Competition Commission (Cofece) have been suspended following a major legal reform. The pause comes as part of the transition to a new regulatory agency, the National Anti-Corruption Commission (CNA), according to a statement from Cofece’s Investigative Authority.

    The suspension began on July 17, 2025, the day after the reform to the Federal Economic Competition Law (LFCE) was published in the Diario Oficial de la Federación. This decree ends Cofece’s operations and initiates the transfer of its responsibilities to the CNA.

    According to the statement, the suspension affects all procedures led by the Investigative Authority. This includes complaints filed under Article 67 of the LFCE, requests for conditional benefits under Article 103, and classification of legal information provided to economic agents, among others.

    In addition, deadlines and legal timelines for new complaints and requests under Articles 67, 94, 96, 100, and 103 will not begin running if filed after July 17. Requests related to the classification of legal information are also on hold.

    “All deadlines and legal timelines will resume the day after the full panel of the CNA is formally established,” the statement said.

    The suspension is based on constitutional reforms published on December 20, 2024, which aim to simplify the federal regulatory structure. A second decree, published on July 16, 2025, modified the LFCE and the Law of Federal Parastatal Entities and triggered the transition process.

    Until the CNA is fully in place, Cofece will continue to operate under the version of the LFCE last updated on May 20, 2021, per the statement.
