E.U.: Commission finds support in ruling against payment card co.

The European Commission has announced in a press release its approval of a court backing the Commission’s ruling that Groupement des cartes bancaires, which manages France’s largest payment card scheme, hampered competition through Groupement’s fees and faxes imposed on new members. Groupement fought the Commission’s ruling, but the E.U. General Court has announced its support of the original ruling. Among other arguments, Groupement attempted to fight the charges by declaring a distinction must be made between “manifest” and “non-manifest” restrictions of competition; the General Court, however, said that Article 101 TFEU’s list of infringements is not exhaustive.
