EU: Bag cartel fires back, sues over antitrust ruling delays

One of the 16 plastic bag companies fined by the European Commission in 2005 for forming a cartel is looking to have its fine reduced, and several other of the involved companies are looking to sue the Commission, over ruling delays. Three companies – Kendrion NV, Gascogne and the Gascogne Sack unit – may seek damages for the ruling delays, which held up their fine appeals from back in 2006. Gascogne Sack is also looking to have its fine cut by more than one million euros. Advocate general Eleanor Sharpson stated that these damages should be awarded to the companies in front of the EU Court of Justice on Thursday, though the opinion was non-binding.
