EU: Court affirms ruling against Dole on banana price fixing

The highest court in the European Union has given the final word on a banana price-fixing case involving Dole Food, ruling that the company must pay its share of an $83 million fine.

    The ruling from the court, filed March 19, means the Westlake Village, Calif.-based Dole has exhausted its appeals in the case.

    The European Commission ruled in 2008 that Dole, along with Coral Gables, Fla.-based Fresh Del Monte Produce Inc. and Hamburg, Germany-based Internationale Fruchtimport Gesellschaft Weichert, had engaged in price fixing from 2000 to 2002 in several European countries.

    The commission imposed the $83 million fine collectively on the three companies. Chiquita Brands International Inc. was also implicated, but the company provided the commission with information to launch the investigation.
