Fox News Challenges Newsmax Antitrust Suit in Wisconsin Court

Fox Corp and its subsidiary Fox News have accused Newsmax of improperly refiling its antitrust lawsuit in Wisconsin after an earlier version of the case was dismissed in Florida, according to Reuters.

    In a legal filing submitted on Monday to a Wisconsin federal court, Fox’s attorneys argued that Newsmax engaged in “impermissible forum shopping” by bringing forward a revised case in a different jurisdiction. The company asked the court to send the case back to the Southern District of Florida, where the original complaint was thrown out.

    Both lawsuits allege that Fox used its market influence to pressure distributors into excluding or limiting rivals such as Newsmax in the conservative-leaning pay TV space. The Wisconsin complaint, like the earlier Florida filing on September 3, accuses Fox of violating antitrust law by suppressing competition, per Reuters.

    In response, Newsmax issued a statement saying Fox News has “hurt consumers and Newsmax all across the country, and we believe this case is admissible in any federal jurisdiction.”

    Fox News, meanwhile, highlighted its Wisconsin filing when asked for comment. The company urged the court not to reward what it described as “procedural gamesmanship” by Newsmax, according to Reuters.
