Italy: Pay-TV giant off the hook from regulator enforcement

AGCOM, Italy’s antitrust watchdog, has decided against hearing a case accusing pay-TV giant Sky Italia of abuse of dominance. The complaint, initiated by competitor Mediaset, accused Sky of purchasing exclusive rights to broadcast EUFA and World Cup soccer content; rights for 2012-2015 were bought for the Champions League of the Union of Europe Football Associations. While Mediaset argued that Sky’s possession of those exclusive rights hinders competition, AGCOM denied the case on the grounds that because the rights are sold every four years, there is no anticompetitive effect. Complaints first emerged in 2010 by Mediaset unit RTI.
