Philippines: Dated laws could stifle effectiveness of new competition authorities

The Philippines Department of Justice, designated in 2011 as the nation’s Competition Authority, has issued guidelines on the implementation of the order given by President Aquino, which also established the Office for Fair Competition. According to the guidelines, the OFC will investigate all matters concerning cartels, monopolies, and restraint of trade cases – the cases will be defined from various laws dating back to 1925, which have remained largely untouched since. According to reports, major companies in the nation have held enough power to prevent any legislative changes concerning restraint-of-trade.
