    The analysis describes 2025 as a transitional year, in which federal and state agencies sharpened their coordination and expanded their expectations around transparency, documentation, and internal controls. Enforcement activity under the False Claims Act and the Anti-Kickback Statute continues at scale, but regulators are now probing deeper into how digital and AI-enabled systems actually function in practice.     At the Food and Drug Administration, inspections are expanding beyond core manufacturing quality to encompass system implementation issues that were rarely examined even a few years ago.     While familiar enforcement tools such as warning letters and Form 483 observations remain central, the agency is also signaling a willingness to use additional mechanisms, including cease-and-desist letters, where governance gaps are identified. Companies that cannot clearly articulate decision logic and validation steps around AI tools may find themselves exposed in future inspections.

    A similar evolution is underway at the Centers for Medicare and Medicaid Services. CMS audits have historically focused on numerical accuracy, but regulators are now shifting toward accountability for the processes behind pricing submissions, rebate calculations, utilization reporting, and coding. CMS increasingly expects companies to demonstrate who generated data, how it was reviewed, and what controls ensure consistency across functions.

    Data privacy enforcement is also becoming more operationally sophisticated. Regulators are less persuaded by written policies and more interested in whether companies truly understand their data ecosystems. This includes mapping data flows, monitoring AI training datasets, and maintaining visibility into how third-party vendors collect and use health information. The growing patchwork of state digital health privacy laws, often stricter than HIPAA and sometimes in tension with GDPR or China’s PIPL, further complicates compliance for biotech companies operating across borders.

    The use of AI in research and clinical development represents perhaps the most consequential compliance challenge. Per OCG, regulators appear less concerned with whether AI systems occasionally err and more focused on whether companies can explain how models were trained, what assumptions they rely on, how outputs are validated, and how errors are remediated in the interest of patient safety.

    Looking ahead to 2026, the analysis identifies two likely inflection points: the emergence of AI-specific FDA inspection standards, including the possibility of AI-focused Form 483 observations, and heightened scrutiny of data-sharing arrangements among biotech firms, academic institutions, and digital health partners. Regulators are expected to demand clearer consent frameworks, stronger contractual controls, and more robust oversight of secondary data use and AI training data.

    For compliance officers, preparation for 2026 will hinge on fundamentals rather than novelty. Clear documentation, cross-functional governance, early escalation of concerns, and defensible explanations of AI-enabled processes may prove more valuable than attempting to anticipate every possible regulatory development. As the analysis notes, regulators do not expect perfection, but they do expect clarity, consistency, and sound judgment in an increasingly complex biotech compliance environment.
