South Africa’s Supreme Court of Appeal has sided with steel companies defending themselves against the Competition Commission, which is accusing the companies of forming a steel cartel, according to reports. The SCA has ruled that the Commission must show the companies, ArcelorMittal South Africa and Cape Gate, documents pertaining to the case. The SCA’s ruling upheld the companies’ cross-appeal, dismissing an earlier appeal by the antitrust regulator. Specifically, the two companies are seeking the documents currently in the hands of the Commission that contain information about Scaw South Africa, the company that first informed the authorities of a possible cartel and subsequently applied for leniency. A complaint was lodged to the Competition Tribunal against ArcelorMittal SA and Cape Gate by the Commission based on the information given by Scaw South Africa.
