South Africa: In first case of its kind, watchdogs brought case against individuals
In the first case of its kind, South Africa’s Competition Tribunal was asked to hear a case brought by an individual accusing other individuals of anticompetitive conduct. Shipping law junior advocate Simba Chitando initiated the case against three senior advocates and is reportedly seeking interim relief against them for alleged “racist, anticompetitive” behavior that he claims excluded Chitando from the shipping law market. Michael Fitzgerald SC, Russell MacWiliam SC and Michael Wragge SC were named as the alleged offenders. Chitando is reportedly requesting the Tribunal to ban the three from engaging in such conduct and to order them to allow Chitando into the pool of junior advocates referred to by the three senior advocates. Chitando is from Zimbawe. Reports say this is the first instance that competition authorities have been brought a case regarding individuals accused of anticompetitive conduct.
