Spain: CNMC requests changes to formula for calculating AENA airport charges

Spain’s National Commission of Markets and Competition (CNMC) has requested the Government to make certain modifications to the formula used to determine the index of airport charges, as the agency believes it includes services that should not be considered and that are beyond AENA’s control.

    The rates, which airlines pay for the right to use AENA’s services, are adjusted annually through a formula that considers, on the one hand, the margins of each service and, on the other, compliance with certain quality and investment parameters.

    These rates determine part of the price of airline tickets that travelers must pay. The CNMC has pointed out that in the calculation proposal provided by the Ministry, several services have been included in which AENA can have “significant control over prices and exercise its bargaining power”, while other elements, such as the salaries of public workers or air navigation costs, cannot be controlled by AENA. For these reasons, the regulator has considered that the current formula is not “coherent”, asking for the necessary modifications to be made.
