Spain: CNMC moves against barriers to competition in Valencia

Spain’s competition regulators presented an official recourse before the National Assembly, seeking to strike down a resolution by Valencia’s Territorial Transport Service which the agency believes violates the necessity, proportionality and non-discrimination principles in the country’s Competition Law.

The resolution, which automatically denies authorisation for transporting goods on the country’s motorways to companies with less than three vehicles, fails to meet the criteria of Spain’s Market Unity Guarantee Law. The agency considered the resolution as unjustified, posing a serious obstacle for new players in this market.
