The criteria established by CNMC include the exemption from the prohibition of contracting with the Public Sector in certain circumstances, such as being leniency applicants or proving the efficient implementation of an antitrust compliance program. Overall, Communication 1/2023 established by the Commission seeks to protect the Spanish Competition Act by assuring that companies involved in an anti-competitive conduct do not have access to the public sector in order to avoid a distortion of the current competition.
