Turkey: Proposed amendment could encourage bid-rigging, say critics

A proposed amendment to lower bid-rigging penalties has drawn major fire from Turkish lawyers who argue the punishments would be insufficient and may fail to deter bid-riggers, possibly even increasing the frequency of the scheme. The amendment was proposed in the fourth judicial reform package, say reports, and will amend Turkish Penal Code 235. The package was put forth from the Republican People’s Party. Under current legislation, bid-rigging results in a five-to-twelve year sentence in prison. The revisions would reduce that sentence from three-to-seven years. The parliamentary Justice Commission approved the package last Friday.
