Uber and the Regulation of Public and Private Individual Transport in Chile. Part 2: The Regulatory Outlook

The purpose of this working paper is to review the current legislation in Chile to determine whether certain passenger transport companies as Uber and Cabify – as well as any other that may potentially enter the market – are acting under the legal framework in this regulated market. For this reason, the focus of this work is the public and private passenger transport in urban areas, and not public transport.

This article consists of two parts. The first part analyzes a panoramic overview of the punitive regulation of public and private passenger transport. In this second part, however, we intend to critically review the regulation of public and private passenger transport, proposing a basis for a modification of the instruments of state intervention in this market.
