UK: Eurotunnel baffled by CC’s latest ferry ruling

Eurotunnel is concerned over the UK Competition Commission’s recent ruling that it does, in fact, have the power to force the company to divest ferry routes, after the Competition Tribunal told the Commission to take a second look at the case.

The France-based company described the Commission’s provisional ruling as “incomprehensible.” The Commission earlier ordered Eurotunnel to divest its route between Dover and Calais following its acquisition of SeaFrance assets.

The Commission was ordered to reconsider its ruling and decide whether the ferry purchases constituted a merger under its jurisdiction. The Commission announced last week that it does have jurisdiction, and that it would continue to order the route given up by Eurotunnel.

Eurotunnel said it is unclear what will happen to the ferries as French competition regulators have barred any sales of the vessels until 2017.
