US: Judge sets date to announce AA, US Airways merger fate

New York bankruptcy Judge Sean Lane announced Monday he would rule on whether to grant the restraining order requested by a private attorney to halt the proposed merger between American Airlines and US Airways, setting the timeline for the airlines to learn their fate in the deal.

The lawyer applied last week for a Temporary Restraining Order against the merger soon after the airlines settled with the US Department of Justice, which had sued to block the case. The lawyer filed the request on behalf of 40 travel agents and passengers who claim the airline merger would harm their businesses.

Judge Lane is expected to rule on whether the merger can finalize or not; if the merger is cleared, it will allow American to move forth with its reorganization plan to exit bankruptcy.
