Colombia: Cabify fined for ‘violating transport rules’

Colombia’s Superintendency of Ports and Transportation ratified the fines imposed on May 4 on ride-sharing company Cabify Colombia, amounting to 516 million Colombian pesos (US$ 172,000), according to Superintendent Javier Jaramillo.

    Jaramillo dismissed the arguments put forward by Cabify Colombia, which maintains it is merely a technological platform that serves as an intermediary between service providers and users. “It is clear that Cabify intends to rid itself of its responsibility by saying that it is only a technological platform and not a provider of transport services. But by recognizing its role as intermediary, the law empowers us to punish it for facilitating the violation of the rules of transportation that govern the country” he said.

    In addition, the Superintendency concluded that Cabify’s app determines the conditions for the service provided: it indicates and establishes a price to the user, establishes access conditions and selects the vehicle. For this reason, according to the entity, the economic influence that this company has in relation to the transport service is inescapable.
