U.S.: FTC, animal health co reach agreement on distribution exclusivity deals

IDEXX Laboratories Inc has signed a Consent Agreement with the Federal Trade Commission to settle an investigation into whether the diagnostics and information technology solutions company had hampered competition. The company specializes in animal health as well as water and milk supply quality. Under terms of the agreement, IDEXX can no longer have exclusive distribution contracts with three veterinary companies at once. The three companies named are MWI Veterinary Supply, Inc., Butler Schein Animal Health and Webster Veterinary. The agreement says that IDEXX can maintain those exclusivity agreements with two at once, however. IDEXX has not admitted to any legal misdoings, and its CEO and chairman Jonathan Ayers said in a statement that the agreement is a “milestone” in resolving the investigation.
