The Competition Tribunal’s decision, after hearing evidence by the two firms on their conduct at the time, finally brings the case, which started in 2009, to an end. The Competition Commission initiated an investigation into the cartel after it received information from Murray & Roberts when the company successfully applied for corporate leniency on behalf of its subsidiary RSC Ekusasa Mining. The two firms were also involved in an agreement to bid low prices for a tender from Goldfields, in an attempt to punish Duraset. Videx also unsuccessfully attempted to fix prices with RSC Ekusasa Mining on a bid for a tender from Harmony in October 2005 so that it could win the bid.
