Australia: ACCC releases updated merger review guidelines

Following a consultation process with the Law Council of Australia, the Australian Competition and Consumer Commission has released its Informal Merger Review Process Guidelines 2013, an updated merger review process aimed at increasing efficiency.

According to the regulator, changes in the updated review process include a pre-assessment process update, necessary to the influx of non-contentious merger filings.

Further, the updated guidelines include new processes for providing merger parties with regulatory feedback on the deals, as well as revised methods to releasing Public Competition Assessments, which outline ACCC decisions on mergers.

ACCC chairman Rod Sims released a statement regarding the revisions, saying the new guidelines should allow regulators to complete merger reviews within eight weeks.
