Italian Regulator Fines Enel X Over EV Charging Practices

Italy’s competition watchdog has fined energy supplier Enel X and its subsidiary Enel X Way Italia a total of 2.3 million euros after finding that the companies abused their dominant position in the country’s electric vehicle charging sector.

    The investigation, launched by the Italian antitrust authority AGCM in spring 2023, centered on allegations that Enel engaged in practices designed to shut out rivals. Per a statement from the regulator, the companies carried out “margin-squeezing practices” that undermined competitors’ ability to enter or expand within the market. According to the authority, the misconduct occurred during 2022 and 2023 and limited both competition and innovation in e-mobility services.

    According to a statement from the AGCM, Enel used its strong presence in the energy market to prevent competing operators from gaining a foothold in the EV charging space. The regulator noted that this behavior ultimately slowed progress in new mobility technologies that depend on a more open and competitive marketplace.

    Enel X and Enel X Way Italia quickly responded to the ruling, acknowledging the decision while firmly rejecting its conclusions. The companies announced plans to challenge the fine, arguing that the authority’s review overlooked key factors, including the early developmental stage of the EV charging market and the extraordinary rise in electricity prices during the period under investigation.

    In an official statement, Enel X and Enel X Way Italia said they “remain convinced of the legality of their conduct and confident in their ability to defend their rights before the competent bodies.” The appeal process is expected to continue in the coming months.
