The Swedish government circulated an options paper seeking member states’ guidance on some of the most controversial points of the new data law, namely the SMEs exemption, B2G data sharing and trade secrets.
The Data Act is a landmark legislative proposal to regulate data sharing. The previous Czech presidency advanced the file, but some critical issues remain open.

As the turn of the year saw the Swedes take over at the helm of the EU Council for the next six months, Stockholm asked the other countries for feedback on the most critical pending issues.
“The Presidency invite the Member States to give their opinion on a few topics where guidance is needed to move forward in an efficient way,” reads the paper, seen by EURACTIV.The paper was presented at the first Working Party meeting of the year on Tuesday (10 January) and will be discussed next Tuesday. The representatives of EU governments had until Thursday to submit their written comments.
The discussions and comments will be the basis for a subsequent compromise text, which has been tentatively scheduled for 31 January.
