Companies and their representative trade association accused of conspiring exclude business deals against Evergreen Partnering Group are seeking a dismissal of the case, say reports. Evergreen filed the case against Pactiv, Genpak, Solo Cup, Dolco Packaging and Dart Container in a district court in Boston in 2011, seeking $25 million in damages, over claims the companies conspired not to do business with Evergreen. The companies are also represented by the Plastics Foodservice Packing Group of the American Chemistry Council. The case, already dismissed by the US District Court in Boston, is now before the US Court of Appeals after vacating the district court’s ruling last June. The plaintiffs now seek a dismissal, filing their motion last Monday.
