MyCC clarifies position on information sharing within an association

The Malaysian Competition Commissioin has distinguished between legal and illegal sharing of information within an association. The clarification comes after the Malaysian Automative Association (MAA) was found to have infringed the Competition Act 2010 for sharing information with MAA members. Shila Dorai Raj, MyCC’s chief executive officer, explained that the practice is a violation when information sharing “may be considered as a form of horizontal agreement between competitors” that blocks or distorts competition. The MAA was thus advised that it could share information between its members, but only historical information that is aggregated.
