The ACCC has declared the non-NBN local bitstream access service. The purpose of the declaration is to set NBN-level broadband access terms for those residences and small businesses on networks not covered by NBN. Wholesale service providers, upon request, must supply the service to retail service providers under standard access obligations as set by the Competition and Consumer Act 2010. The declaration applies only to those “superfast” networks built or upgraded after January 1, 2011, and does not apply to mobile, wireless or satellite networks. The declaration is expected to take effect on April 13, 2012, or earlier.
