EU: Deutsche Bahn fails in pursuit against EC raids

Deutsche Bahn failed in its appeal of a European Commission’s earlier decisions resulting in antitrust raids of the firm’s offices on grounds the raids broke EU law.

Deutsche Bahn filed the appeal in the EU General Court, which ruled Friday that the Commission’s inspections of the railway in 2011 were legal, despite the railway’s description of the raids as a “fishing expedition” to find evidence of anticompetitive behavior.

The raids were orderd following complaints by DB Energie against the railway; a second and third search were issued following the first, and soon thereafter the Commission opened a formal investigation into the matter.

Deutsche Bahn did not immediately respond to reporters’ requests for comment.
