EU: T-Mobile earns win in frequency battle with rival Hutchinson

An administrative court in Vienna has served welcome news for T-Mobile Austria: the wireless company’s appeal of rival Hutchinson Whampoa’s buyout of Orange Austria has moved forward and will be referred to the European Court of Justice. T-Mobile had originally opposed of the deal, arguing it put the company at a competitive disadvantage due to the spectrum allocation to Hutchinson as a result of the acquisition; according to T-Mobile, the deal gives its rival a significant advantage when developing newer networks, specifically the LTE, or long-term evolution, high speed network. According to T-Mobile, the court in Vienna has requested a quick decision by the European court ahead of a September frequency auction.
