Malaysia: Nestle goes around MyCC to keep pricing policy

Nestle Sdn Bhd has reportedly decided to abandon its efforts with the Malaysian Competition Commission, or MyCC, to defend its pricing policy and instead take up the issue with the Ministry of Domestic Trade, Cooperatives and Consumerism. MyCC previously asked Nestle to change its pricing policy, which currently prohibits re-sellers from independently pricing the products. MyCC called the practice “anticompetitive.” According to reports, Nestle has withdrawn its individual exemption application first filed with MyCC. In a statement, Nestle maintains that its argument is still valid but has decided to take up the matter with the Ministry.
