Mexico: Court strikes down sanctions against Telcel

Mexico’s First Administrative Court for economics, radio and telecommunications has struck down a previous ruling, which had ordered mobile operator Telcel to pay a 12 billion peso fine due to abuse of dominance.

The court, through its Federal Judicial Council, declared the annulment “decreed because the acts denounced by the plaintiff companies during the procedures followed by the Federal Competition Commission (COFECO) against Telcel had concluded with the approval of a series of compromises, presented to the company to be fulfilled between 2011 and 2014.”

Thus, the court’s resolution “left the Cofeco’s decision to approve these compromises untouched, which makes the fine of approximately 12 billion pesos ineffectual”, the court concluded.
