South Africa: Commission analyst warns against ‘disastrous’ price regulation

South Africa’s principal policy analyst for the nation’s Competition Commission says that attempts to create the watchdog into a price regulator would be “disastrous” as it would contradict the regulator’s orders under the Competition Act.

    Analyst Khanyisa Qobo made the remarks at the seventh annual competition law conference last Thursday, held in Johannesburg.

    During her speech, Qobo highlighted the “contradiction” of the Commission’s duty to promote fair competition “while simultaneously intervening in markets through price-setting, possibly towards uncompetitive outcomes.”

    The analyst also discussed the role state aid plays in national competition policy in the context of state intervention and enforcement of competition policy.
