South Africa: Indie storeowners struggle for their share of price-fixing settlement

After a 2007 case found three food manufacturers guilty of fixing bread prices, reports say about 100 local, small business owners on the Western Cape are looking for compensation from the scandal. The case found Tiger Brands, Pioneer Foods and Premier Foods guilty of the charges. Now, as the storeowners have applied to receive compensation, the Constitutional Court will hear the request after the Supreme Court of Appeal ruled that the owners could not issue a class action against the companies to receive payment. The Competition Tribunal, however, has recognized the modest means of many of the business owners, noting that a class action could be the only possible way for individuals to receive compensation.
