South Africa: Long repeals process may mean win for Competition Commission in brewer case

The Competition Appeal Court has announced it has halted a decision by the Competition Tribunal to end a major part of the Competition Commission’s case against South African Breweries (SAB). The Competition Commission may now have its case against SAB be heard. In a case that began from a distributer complaining he did not get the same discount as other distributors from SAB, an investigation launched into the breweries found evidence of price-fixing and abuse of dominance in certain geographical markets. The Competition Tribunal decided in April 2011 to end a large part of the investigation, but the Competition Appeal Court’s recent decision may mean a win for the Competition Commission.
