Spain: Regulator orders Orange to give competitor 4G access

Spain’s telecoms regulator CNMC has ordered Orange Spain to give rival operator MasMovil temporary access to its 4G network within the next ten days after accusing the network service provider of incurring in a “clear breach” of a contract signed in May 2013. Under the terms of that contract, Orange committed to providing a wholesale 4G service within a “reasonable” timeframe.

The regulator’s decision comes after it called on the country’s main 4G network operators – Telefonica, Vodafone and Orange – to guarantee wholesale access to their 4G networks in reply to a consultation filed by MVNO association AENOM in July. The CNMC reiterated that the main network operators are obliged to negotiate “in good faith” with the MVNOs and to guarantee “reasonable prices” for 4G services to guarantee a level playing field.
