France: The competition benefits of eCommerce for French consumers

The French Competition Authority (FCA) highlighted its appraisal of competition law principles in the field of e-commerce. Manufacturers and Retailers ensure that their marketing agreements do not curb the development of e-commerce. They state that each manufacturer is free to organize its distribution system provided it does not harm competition. It is therefore justifiable, in a selective distribution network, for a manufacturer to demand that a retailer’s website comply with certain quality standards in the same way as its physical retail outlets do so. However, off-line distribution methods should not be favored over on-line distribution methods.
