US: $100M suit against supermarket chain tossed, plaintiff vows to appeal

Delta Produce LP’s $100 million lawsuit against supermarket chain H-E-B may have been tossed out by a federal judge, but Delta has vowed to appeal the ruling. Delta alleges the supermarket giant barred the produce company from selling various produce to the supermarkets’ competitors, according to court documents. Additionally, Delta is blaming H-E-B for its financial woes, which entered bankruptcy earlier last year after three decades in business, accusing the chain of reducing orders from Delta until it lifted its restrictions in 2008.
