US: Apple loses key case against Amazon ahead of DOJ e-books trial

Apple Inc. has reportedly been denied its request for documents from Amazon.com to determine Amazon’s motivation to switch its agency model concerning the pricing of e-books and the signing of agency agreements with e-book publishers. Amazon has also refused those discovery requests as Apple is looking for evidence to defend itself in the Department of Justice’s case against Apple; the government claims Apple conspired with five e-book publishers, all of whom have since settled with the DOJ, to raise e-book prices. Apple is scheduled for a June trial and, according to reports, Apple’s inability to get its hands on those Amazon documents may deal a major blow to the company in its defense.
