US: DOJ cleared for eBay pursuit

In separate rulings, US District Judge Edward Davila ruled that the US Department of Justice, but not the state of California, would be allowed to proceed with a lawsuit against online auction retailer eBay in its alleged non-compete agreements with Intuit.

    In his ruling, Judge Davila said the US “plausibly alleged an actionable agreement between the two companies.”

    EBay is accused of making agreements with Intuit not to recruit each others’ employees. The company was first sued in November of last year following claims that then-CEO Meg Whitman and Intuit founder Scott Cook made the non-compete agreements in 2006.

    Reports say Intuit was not named in the DOJ’s lawsuit, as the company is the subject of another separate order.
