US: DOJ streamlines process to alter antitrust settlements

The US Department of Justice Antitrust Division announced Friday it has introduced new policies to streamline parties’ ability to change or terminate old antitrust settlements, a move the authority said will lower costs and expedite the review process for such requests.

According to reports, the changes, which are effective immediately, update policies that had not been updated since 1999. Antitrust settlements made prior to 1980 can now use a new process to change or cancel the settlement.

The changes address the lack of automatic terminations held by settlements made before 1980. According to reports, judgments made after 1980 contain “sunset” provisions that automatically terminate the settlements after a period of time. But judgments made before that time do not include such provisions.
