US: Judge Cote keeps faith in Bromwich, against Apple’s wishes

After the US Department of Justice slammed Apple’s complaints against its court-appointed monitor as “character assassination,” US District Judge Denise Cote, who established the monitor, denied Apple’s request to have the watchdog removed.

Lawyer Michael Bromwich was chosen to monitor Apple’s business practices to ensure compliance with antitrust law after Judge Cote found Apple had conspired to fix eBooks prices. Apple recently submitted complaints about Bromwich, claiming he overstepped his boundaries as a monitor and was hampering Apple’s ability to function.

But Judge Cote said in her decision that she wants “the monitorship to succeed for Apple,” and therefore will not remove Bromwich from the duty. Judge Cote also denied Apple’s claims that Bromwich overstepped his authority by filing a declaration.

While Judge Cote has yet to publish her complete decision, Apple has 48 hours to file an emergency stay to appeal her ruling.
