Colombia: Court orders Facebook to better protect personal data

The Superintendence of Industry and Commerce (SIC) of Colombia has ordered Facebook to adopt new measures to guarantee the security of personal data for the more than 31 million Colombians who use the social network. The cautionary order issued by the SIC specified that Facebook will have 4 months to comply with the measures.

    The measures, according to a statement issued by the SIC, must be “appropriate, useful, effective and demonstrable …” in order to comply with the obligation of protection of personal data to which Facebook is held. They must also acquire a certification issued by an independent entity specialized in information security issues that demonstrates an improvement in the company’s security practices.

    “Whoever issues the certificate will be selected by Facebook, but it must be a third party whose management is free of any conflict of interest, that is independent and unrelated to any kind of subordination to Facebook,” the SIC stated. Facebook has 31 million users in Colombia, which represents 68% of Colombia’s population.
