Antitrust enforcer at the US Department of Justice, Bill Baer said he expects companies planning to merge and facing antitrust reviews should plan on meaningful concessions or risk being sued, according to a report by Financial Trust.
“If parties want to do a deal and think we will accept remedies that are milk toast, it’s not worth their time,” said Mr Baer, an assistant attorney-general. “We’ll see them in court.”
The DoJ has been less willing to approve initial concessions offered by companies seeking antitrust approval since Mr. Baer has joined the DoJ. Mr. Baer said his strategy had been successful in maintaining competition in areas where mergers had taken place.
