EU: General Court backs Commission’s glass price-fixing fines

Glass manufacturer Pilkington lost its challenge to a fine issued in 2008 by the European Commission for price-fixing, reports say.

    The EU General Court decided Wednesday that Pilkington’s fines should not be reduced after the company, a unit of Japan-based Nippon Sheet Glass, argued that the Commission incorrectly applied competition law to calculate the sanctions.

    Pilkington, Saint-Gobain and two other firms were fined a combined $1.68 billion for price-fixing; Pilkington alone was ordered to pay $445 million. UK-based Pilkington had appealed the fine and asked the General Court, the EU’s second-highest court, to reduce the penalty.

    But in is ruling, the General Court found “the fine appears proportionate and adequate.”
