The secretary of the Department of Health and Human Services is pinpointing the tension that has developed between the Affordable Care Act and antitrust law. Kathleen Sebelius spoke at the Harvard School of Public Health to address the issue that, she says, leads to crucial, “constant” oversight of the sector so as to avoid competition issues. The Act has lead to healthcare entities searching for partnerships to increase efficiently and technological advances – a trend that may run into antitrust issues down the road. As such, some regulators are looking to implement educational guidance on antitrust within healthcare bodies – the American Hospital Association has reportedly lobbied for “user-friendly” guidance on the application of antitrust law within the healthcare field to ease some tension.
