France: Competition authority’s merger control powers legally justified

The French Competition Authority’s powers over merger control were declared constitutional by the French Constitutional Counsel after it was determined the FCA can withdraw merger authorizations if the parties involved did not uphold their commitments in the deal, as well require the parties involve to re-notify the transaction. The ruling comes after the competition authority withdrew its approval of Vivendi Universal and Canal Plus to have sole control over TPS and CanalSatellite in 2011, requiring the deal to be re-notified by Vivendi Universal and Canal Plus.
