Switzerland to enter co-op with EU antitrust

    Having already entered bilateral cooperation agreements with non-European nations like the United States and Japan, the European Union plans to enter an even tighter cooperative agreement with Switzerland. The so-called “second generation” agreement allows the countries to exchange subpoenaed information from companies under investigation without company approval, requires the countries to notify each other of enforcement activities that would have a bearing on the other, and allows them to coordinate their efforts to enforce overlapping antitrust actions. The agreement may, in the future, serve as a model for closer-knit agreements between enforcers.
