Delayed divestitures cost Carrefour 10,000 euros a day

Poland’s Court of Appeal upheld a PLN 542,412 fine imposed on Carrefour for the delayed divestitures of two trading centers. The Court of Competition and Consumer Protection had upheld the fine in October 2011. The Court of Appeal’s decision is final, so Carrefour can no longer appeal the fine.

    The UOKiK had approved Carrefour’s acquisition of Ahold so long as it sold its rights to nine stores by the end of 2008. Yet Carrefour did not sell Champion in Grodzisk Mazowiecki and Albert in Jaworzno until nearly a month past the deadline. As a result, Carrerfour was fined in 2009, as calculated by Polish competition law, which sets a rate of 10,000 euros a day, for each day the decision is delayed.
