Spat over professional Rules and competition law resolved at CompCom-LSSA meeting
On April 2, South Africa’s Competition Commission and council members of the Law Society of South Africa (LSSA) met to discuss a Commission decision. The Commission had refused to grant the LSSA an exemption from the professional Rules of the statutory provincial law societies. The outcome of the meeting is to interpret and apply the current Rules so as not to contravene competition law until the new Legal Practice Bill is finalized. The Competition Commission and the LSSA have agreed to apply existing Rules on professional fees and advertising, with the exceptions that attorneys can charge fees below the minimum rate and that restrictions on truthful advertising are lifted.
